Trust Asset Protection: Recent Developments

Safeguarding trusts set up for third party beneficiaries is much easier than protecting your own assets and currently only a limited number of states allow for Domestic Asset Protection Trust (DAPT).

Still with trust protection legislation in place, many practitioners in these states question how well these DAPT’s would stand up to judicial scrutiny. Such concerns have been put to ease, at least in one state. On May 25 of this year, the Nevada Supreme Court issued a ruling on Nevada Asset Protection Trusts (NAPTs), reaffirming their dominance as an asset protection vehicle.
